Md. mortgage fee lawsuit reinstated

A ruling yesterday from the state's highest court over prepayment mortgage charges could make it more expensive for some to obtain home equity loans, the banking industry's trade association warned.

The Maryland Court of Appeals found that state-chartered Provident Bank assessed a "prepayment charge" that's not allowed under state law. The bank had waived $680 in closing costs on a $17,000 loan to Andrew Bednar in 2003 but collected the money after the loan was paid off early when he refinanced with another lender two years later.

The ruling overturns a decision by Baltimore Circuit Court to dismiss the lawsuit against Provident.

Tom Brokaw

He suggested incivility was a "big cancer" on America, and talk radio is the number one tumor. Front and center in Brokaw's pathology was Limbaugh: "My problem with the whole spectrum is there is not -- you know what Rush's, what his whole drill is. He doesn't want to hear another point of view. Except his."

Bates applications now at schools

It's time again for some of Wayne County's best senior student-athletes to be recognized for their hard work.

Applications for Roy S. Bates Foundation scholarships were distributed to area high schools this week. Interested students should ask their school atheltic director where they can get a form if they don't have one already.

The Foundation will award scholarships in the spring to deserving athletes for the 14th year in a row.

This year, eight $2,000 one-time scholarships will be awarded, for a total of $16,000. The Foundation's executive committee will also pick the Bates Foundation Player of the Year from that group.

Bates, who died in 2004 at the age of 88, was an area sports legend as a former athlete, coach and radio announcer.

Coke susbidiary SPC Ardmona cuts 50 jobs

COCA Cola Amatil subsidiary SPC Ardmona has cut 50 staff from its permanent workforce, citing drought and increasing import volumes of processed fruit and vegetables.

SPC said the restructure resulted in both redundancies and a number of vacant positions not being filled.

"We regret having to take this step,'' managing director Nigel Garrard said.

"We have been dealing with the effects of this drought and the competition from imported products for some time, and have managed to keep the business profitable and our growth plans on track.''

"However, to remain competitive, we have had to make the hard decision to take further costs out of the business and restructure our operations.''

Mr Garrard said the cost of the restructuring would be covered by operational and other cost savings across SPC and the wider Coca Cola Amatil group.

Here's another Patriot team in tiptop form

But Anderson is planning to retire in February after 19 years on the job at the transportation and real estate company. That's the longest current tenure of any CEO of a Jacksonville public company.

"It seemed to be time," Anderson said Thursday.

"Its human capital and its financial position are in good shape. I would not leave if it weren't," he said.

Anderson will be succeeded as president and chief executive of Patriot by John Baker, the former CEO of Florida Rock Industries Inc. Patriot was spun off from Florida Rock as a separate public company in 1986, and Baker has been on the board all that time.

Anderson will turn 63 in March and while he's retiring from Patriot, he doesn't plan on being idle.

"I intend to look for an opportunity. I don't know what that might be," he said.

Humiliation for Edwards

The three Republican presidential contenders denouncing you….Do you want to do any response?

C'mon it was a joke. I would never insult gays by suggesting that they are like John Edwards. That would be mean.
Did any of these guys say anything after I made the same remark about Al Gore last summer? Why not? What were they trying to say about Al Gore with their silence?

Nagourney's blog about the incident is here. ... Update: Nagourney's print piece is up. He quotes more of Coulter's email than he does on his blog (which is odd since it's usually the other way around). He also makes it clear he solicited Coulter's response.... 6:41 P.M. link

Get-up-and-get-a-beer line of the day: According to the NY Post, Newt Gingrich "doesn't think Obama can win."

"If the country wants therapy, they're going to elect Obama," he said.
